Cohabitation Agreements

Much like ‘prenups’, cohabitation Agreements are not the most romantic topic, yet entering into a Cohabitee Agreement should be on your priority list when taking that step to live together, especially if it’s a property owned in one party’s sole name that you intend to make home.

Essentially, a Cohabitation Agreement is a legal document, design to set out a cohabitating couples financial affairs, including interest in property, arrangements for children, what will happen if you split or in the event of death.

A Cohabitating Agreement may prevent lengthy and costly legal disputes for example claims under the Trust of Land and Appointment of Trustees Act 1996 (TOLATA), in which one party of a relationship may pursue a claim against a property even if the property is the others sole name.

A Cohabitating Agreement may also provide peace of mind by making provision for managing the unexpected such as, one party suffering serious illness, as well as providing for future planning in the event of the death of either party, providing the proper provision of your loved one.
