EEA nationals and their family members continue to enjoy the right of admission into the UK without the need to make an application for leave to enter or remain. 

EEA Nationals and Swiss National are afforded an automatic right to enter and reside in the UK for an initial period of three months. However, to continue residing in the UK beyond this period, they are required to show that they are a ‘qualified person (exercising their treaty rights in the UK). A person qualifies under their category if they are:

  • Job seeker;
  • worker;
  • self-employed person;
  • self-sufficient person; or
  • student

Family members and Extended family members

Family members of EEA nationals include:

  • spouse or civil partner
  • Dependent children or grandchildren under 21 or those of their spouse or civil partner.
  • their (or their spouse or civil partner’s) dependent parent or grandparent

The above individuals can obtain a family permit to join their sponsor in the UK provided that he or she is in the UK as a ‘qualified person.’

Extended family members including unmarried partners of an EEA national and other relatives not falling in the above category can also apply to join or remain with their sponsors in the UK. 

Effects of Brexit

As of 31 January 2020, the UK is no longer a member of the EU. We are currently in a transition period which will end on 31 December 2020.

In light of the UK’s decision to leave the EU, if you are an EU, EEA or Swiss citizens living in the UK and their family members will be required to apply to the EU Settlement Scheme if they wish to continue living in the UK. The status obtained will depend on the length of an individual’s residence in the UK.

With the new changes, EEA decisions are to be treated as immigration decisions and where an application is refused, it does not attract a right of appeal. Please refer to our ‘Appeals’ page for further details.
