Following the Government’s consultation paper ‘A Fairer Pathway to Settlement: Statement and Accompanying Consultation on Earned Settlement,’ there is potential for reforms to the UK settlement system. While the proposals are not yet law, there is discussion of extending the standard settlement period for certain work routes to a 10-year baseline under an ‘earned settlement’ model.

This note provides strategic guidance where an individual is eligible for both the Spouse/Unmarried Partner route and the Skilled Worker route.

2. Current Legal Position

  • Skilled Worker – currently a 5-year route to settlement (ILR).
  • Spouse/Unmarried Partner – currently a 5-year route to settlement (ILR).

The earned settlement proposal has not yet been implemented and no formal changes to the spouse route have been confirmed.

3. If Skilled Worker Becomes a 10-Year Route

If the earned settlement reform extends the Skilled Worker route to a 10-year settlement pathway while the spouse route remains at 5 years, the spouse route would generally be more advantageous for long-term settlement planning. If the individual is in a genuine and durable relationship and can meet the financial requirements, the Spouse/Unmarried Partner route is generally recommended for long-term settlement planning, particularly if Skilled Worker settlement is extended to 10 years.
