Our client, a successful private care company, instructed us after receiving a revocation of sponsor licence notice from the Home Office. The implications of the decision were huge. A considerable number of their existing workforce were made up of skilled workers. The notice meant these individuals could no longer work for our client. The notice also meant the company could no longer sponsor skilled workers from outside the UK as they were immediately removed from the register of licensed sponsors.
Our client was clearly concerned with the financial and reputational consequences of the revocation and the direct impact on their workers and dependent family members. In the last few years, the company had worked tirelessly to secure tenders from the Local Authority, which were now at real risk of being withdrawn and reallocated to a different company.
Our first step after being instructed was to review the decision and all relevant papers pertaining to the suspension and revocation notices. The case was more complex than usual, as our client’s previous legal representative had prepared the challenge against the suspension notice. Our options were therefore limited, as a challenge against a revocation can only be made in certain circumstances. Nevertheless, we took on the case and prepared a strategy. After months of back and forth with the Home Office, our client received a decision that the revocation of their licence was withdrawn due to our representations. This was by no means a straightforward case. The successful decision was down to the hard work of my team, namely Sajjad Hussain (Solicitor) and Sophie Sprott (Paralegal), and the cooperation and trust our client had in us throughout the matter.
